Proxus provides an Industrial Internet of Things (IIoT) platform that includes data collection, processing, visualization, and integration services for industrial applications. The specific features and functionality available to you depend on your subscription plan and license agreement.

3. User Accounts

To use certain features of our Services, you may need to create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

4. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Services or servers
  • Reverse engineer or attempt to extract source code
  • Use the Services for any illegal or unauthorized purpose

5. Intellectual Property

The Services, including all software, content, trademarks, and intellectual property, are owned by Proxus LTD or its licensors. Your use of the Services does not grant you any ownership rights. You may not copy, modify, distribute, sell, or lease any part of our Services without our written permission.

6. Your Data

You retain ownership of any data you upload or input into the Services ("Your Data"). By using the Services, you grant us a license to process Your Data solely for the purpose of providing the Services. We will handle Your Data in accordance with our Privacy Policy and applicable data protection laws.

7. Payment Terms

If you subscribe to a paid plan, you agree to pay all applicable fees. Fees are non-refundable except as required by law or as otherwise specified in your subscription agreement. We reserve the right to change our pricing with reasonable notice.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROXUS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Proxus and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Upon termination, your right to use the Services will cease immediately. Provisions that by their nature should survive termination will remain in effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Tekirdağ, Turkey.
